dated 12.09.2002,
and
The Common position adopted by the Council, 12695/02, dated 12.11.2002,
With special emphasis on the promotion of pure plant oils and the environmental
impact of different biofuels.

Introduction and Summary
Introduction:
Along with the Interinstitutional file 2001/0266(COD), the
present Directive formed part of the proposed Directive COM(2001)0547. The
present Directive, referred to as COM(2001) 0547-1, concerns the general
promotion of biofuels whereas the closely related Directive, referred to as
COM(2001)0547-2, concerns the excise duty on biofuels.
Obviously, the two Directives are closely related, and
consequently they should be consistent.
This is the case with the European Parliament legislative
resolutions on the two Directives.
The present comparison points out the lack of compliance of
the Amended proposal from the Commission and especially the Common position
adopted by the Council with the Amendments in the European Parliament
legislative resolution and hence the lack of consistency with the related
proposed Directive COM(2001)0547-2.
Summary:
Overall conclusion: The Amended proposal and especially the
Common position have removed or weakened all the most significant Amendments
in the European Parliament legislative resolution concerning the emphasis on
and special promotion of pure plant oils, as well as the general priority of
environmentally superior biofuels. Apart from weakening the promotion of
environmentally sound solutions, the present Directive becomes inconsistent
with the related proposed Directive on excise duty on biofuels.

Introduction et Résumé
Introduction :
Associée au dossier interinstitutionnel 2001/0266 (COD),
la présente directive faisait partie de la Proposition de Directive
COM(2001)0547. La présente directive, dénommée COM(2001)0547-1, concerne la
promotion générale des biocarburants alors que la directive associée sous
le nom de COM(2001)0547-2 concerne les droits d’accises applicables aux
biocarburants.
Evidemment, les deux directives sont intimement liées et
doivent donc être compatibles.
C'est le cas avec les résolutions législatives du
Parlement Européen sur ces deux directives.
La présente comparaison souligne le manque de conformité
de la proposition d'amendement de la Commission et surtout de la position
commune adoptée par le Conseil avec les amendements de la résolution législative
du Parlement Européen, et par voie de conséquence le manque de compatibilité
avec la Proposition de Directive COM(2001)0547-2.
Résumé
Conclusion générale : La proposition amendée et
surtout la position commune ont déplacé ou affaibli tous les amendements les
plus significatifs de la résolution législative du Parlement Européen
concernant l'accent et la promotion spéciale des huiles végétales pures,
aussi bien que la priorité générale des biocarburants supérieurs du point
de vue environnemental. Outre le fait d'affaiblir la promotion de solutions
saines du point de vue environnemental, la présente directive devient
incompatible avec la proposition liée aux droits d’accises applicables aux
biocarburants.
